Terms
In order to rent a vehicle from VIA CAR, the renter must fulfill the following requirements:
• The renter must be over 21 years old and have held a driver's license for at least one year.
• The renter must be at least 24 years old and have a driver's license issued at least 3 years ago to rent first Class, VAN and Luxury vehicles.
• The renter's driver's license must be valid in Europe or worldwide.
• The renter must have a valid ID card or passport.
Renters between the ages of 18 and 24 are considered young drivers. Additional charges may apply for young drivers.
• A valid driver's license and a credit card.
• A passport or identity card.
• A full address / proof of address (house number, street name, zip code, city and country).
• A printed or digital booking voucher. Please ensure the voucher contains all information. Please check your reservation confirmation to find out more.
• If the renter has not paid in advance, a deposit will be blocked on the credit card.
• Special authorization from VIA CAR Management must be presented.
• The renter or additional driver has to provide a phone number and a valid delivery person and to note any damage or scratches on the handover report upon collection.
VIA CAR reserves the right to refuse a rental agreement that includes all rental guidelines.
• VIA CAR vehicles may not be used for racing, speed testing, learning to drive, commercial purposes, subletting, or for any other unauthorised purpose.
• Smoking, including e-cigarettes, is strictly prohibited in the vehicles.
• The intended gasoline (diesel or gasoline) and AdBlue must be used according to the manufacturer's specifications. The renter will bear the costs for all damage that will result in the cost of the repair being borne by the renter.
• The tire pressure should always be kept at the correct level.
• Unauthorized repairs and towing by the renter are not permitted.
• In the event of an accident, the renter is obliged to inform VIA CAR and notify the local police without valid police report the renter is liable for the full cost of the damage.
• In the event of a vehicle defect affecting safety, an incident, or a fault, the renter is obligated to inform VIA CAR immediately and provide a photographic report of the problem.
• If the vehicle is not visibly clean, an amount of €200 or more will be charged for cleaning an unclean vehicle.
• The rented vehicles and their accessories must be parked in a controlled parking lot.
In the event of a violation of the listed obligations and prohibitions, the renter will be required to bear the full cost.
• VIA CAR accepts the following payment methods: cash, credit cards, payment links, and bank transfer.
• In the case of bank transfer, confirmation of payment must be presented when collecting the vehicle.
• In the event of no-show or cancellation, the customer will be charged the costs set out in the booking and cancellation policy.
• If the customer receives the vehicle and then requests to return it for any reason, VIA CAR has the right to cancel the booking, and the customer will not receive a full or partial refund.
• VIA CAR has the right to upgrade the vehicle without the prior consent of the renter.
All VIA CAR vehicles are insured, the insurance cover includes:
• The policyholder takes out liability insurance with an insurance company to protect against claims by third parties.
• Liabilities to third parties (excluding drivers) for injury and death as specified in the insurance policy.
• Property damage to third parties (with the exception of rental vehicles) in accordance with the insurance policy.
• Please note that if the vehicle is damaged or lost due to negligence on the part of the renter or failure to comply with the terms of the rental agreement, the renter is liable.
However, VIA CAR customers can obtain additional insurance to reduce liability under certain circumstances. Additional insurance packages are available (Silver – Gold – Platinum).
All VIA CAR vehicles are insured.
• If the damage was caused by negligence or careless driving, the entire cost of the damage will be borne by the renter or customer.
• The cost of damage to the interior of the vehicle in the event of an accident must be borne by the customer.
• Interior damage is not covered by the insurance, in case of interior damage the renter is fully responsible for the entire cost.
• If the child seats or other accessories are soiled, damaged or lost when the vehicle is returned, the renter must assume full responsibility.
• Zone 1: Austria, Germany, Switzerland, Netherlands, Lichtenstein, Luxemburg, and France (Super limited liabilities applies).
• Zone 2: Italy, Slovenia, Portugal and Slovakia (Only half coverage insurance applies. And special permission needed from VIA CAR).
• Zone 3: Poland, Czech Republic, Bulgaria and Hungary (Only third-party coverage and special permission needed from VIA CAR).
• The Renter may return the rented vehicle at several locations, including VIA CAR locations or at a mutually agreed location.
• The minimum rental period is one day (24 hours). After the 26th hour, the Renter's credit card will be charged for an additional day.
• If the car key or any other accessory is lost or damaged, the customer will be charged a fine accordingly.
There will be an additional charge for the vehicle replacement if the error caused by the Renter.
VIA CAR provides additional equipment available upon request such as:
• Infant carriers.
• Child seats for children aged 6 months and older.
• Wi-Fi Never and Mobile phone.
• GPS navigation system.
Any change or cancellation must be made at least 10 days before the arrival date. If a change is made less than 5 days before arrival, a fee of 15% of the total value of the booking will be charged. If a cancellation is made less than 5 days but more than 24 hours before arrival, a fee of 45% of the total reservation will be charged. If a cancellation is made within 24 hours of arrival, or in case of no-show, the total reservation will be charged. For cancellations made other than us to VIA CAR will not provide any refund. By providing credit card details, you authorize us to debit your account with the booking fee. The credit card will be charged for every unpaid cancellation fee. Any cancellation must be made in writing by email to booking@viaacar.com
telephone cancellations will not be accepted
In the event of polluting the vehicle interior (i.e., dirt, stains, animal hair, sand, etc. on the seats, floor, or trunk) that requires special cleaning, the renter is obliged to pay a cleaning fee of minimum 250 €.
The transport of the vehicle is prohibited without the authorization of VIA CAR. If a vehicle is transported by a ferry, the renter must return it to the pick-up location. In the event of a breakdown or accident, the renter is responsible and he or she is responsible for the cost of transporting the vehicle back to a VIA CAR location.
Cross-border travel requires prior authorization from VIA CAR. The cost of issuing a Green Card and International Road Assistance is borne by the Renter. Please inform VIA CAR in advance if you plan to drive the vehicle abroad. If the renter wishes to extend the rental after picking up the vehicle, he must contact VIA CAR 48 hours in advance or as soon as possible.
If the renter wishes to return the vehicle before the agreed-upon date, they must notify VIA CAR 48 hours in advance. There will be no refund for the unused days.
All vehicles have a full petrol tank. The renter must refuel the vehicle before returning it, otherwise a refueling fee will be charged. We charge each quarter 30€.
The renter is responsible for all fines or other fines will be borne by the renter. The processing fees for each violation will be 45€.
All local taxes apply to the Renter's reservation costs.
If individual provision of these conditions are obsolete or incomplete or that their execution becomes impossible, the validity of the other provisions will not be affected. The contractual parties undertake the replace the invalid provision with a valid and eligible provision which, in terms of content, closely approximates the original intention and the economic objective pursued. Any changes or additions to these conditions require to form to provide by the test, such as email. This provision also applies to a modification of the requirement for the written form. As soon as the customer after a modification uses the services of VIA CAR, he implicitly accepts the new conditions. All other contractual conditions of the customer are only valid if they are explicitly accepted to the acceptance of the contract; do not become part of the said contract. They are valid only if and to the extent that they have been expressly accepted in writing by VIA CAR.
Austrian law applies to all rental contracts in Austria. The courts competent to deal with any litigation are the courts of Vienna.
